1. Who we are
Pengon is operated by Quad Studio, a sole proprietorship based in Zürich, Switzerland. When these terms say “we”, “our”, or “Pengon”, we mean Quad Studio. When we say “you”, we mean you - the human or company using Pengon.
2. What Pengon does
Pengon is an AI-powered spam filter for Squarespace contact-form submissions. A short JavaScript snippet on your Squarespace site forwards submissions to our classifier; messages flagged as spam are quarantined in your dashboard rather than reaching your inbox. Real client messages pass through normally.
Pengon does not replace Squarespace, your email provider, or your responsibilities for reviewing submissions. It’s a filter layered on top of what you already have.
3. Plans and pricing
Pengon is sold in three ways:
- Subscription - US$8.99 per month or US$90 per year, per Squarespace site. You can start with a 21-day free trial that requires no payment method: sign up, install the snippet, and Pengon protects your form for 21 days at no cost. When the trial ends, protection simply pauses - nothing is ever charged automatically, and you are never billed without entering payment details yourself. To keep protection on, add a card and subscribe (you can do this at any point, during or after the trial). Subscriptions then renew automatically each billing period until cancelled; cancelling stops future charges and your access continues to the end of the period you’ve already paid for.
- Founding Member (lifetime) - a one-time payment of US$50, limited to the first 20 seats. That payment grants you access to Pengon for life, with the price locked in and no recurring charges. Section 4 explains honestly what “lifetime” means. Founding Members are not affected by changes to regular pricing.
- Agency / multi-site - volume pricing for studios running several Squarespace sites, arranged individually by email until self-serve multi-site accounts ship. Anything agreed in that conversation applies alongside these terms.
All prices exclude VAT / sales tax; Stripe Tax adds your local rate at checkout where applicable. Payments are processed by Stripe; we never see or store your card details.
4. What “lifetime” means honestly
We’re committed to running Pengon for as long as the service is viable, but we can’t guarantee perpetual operation if circumstances change drastically (regulation, infrastructure provider exits, Quad Studio dissolving, etc.). If we ever need to wind Pengon down:
- We’ll give Founding Members at least 90 days’ notice by email before service ends.
- We’ll provide a full data export (your submissions, training-corpus rows traceable to you) before shutdown.
- We’ll offer a pro-rated refund of the original $50 based on how long the service ran - e.g. if Pengon shuts down after 1 year of operation, refunds reflect that you got 1 year of service instead of a true lifetime.
This isn’t a contract scam phrase - it’s an honest acknowledgement that “lifetime” on a software service depends on the service surviving.
5. Service availability - beta status
Pengon is in active open beta. We expect it to work reliably, but we don’t guarantee uptime, error-free operation, or specific spam-detection accuracy. The AI classifier is continuously being refined; occasional false positives (real messages flagged as spam) and false negatives (spam reaching your inbox) are expected and improve as the training corpus grows.
We recommend keeping the Squarespace built-in spam filter as a secondary layer rather than relying solely on Pengon during beta.
6. Your responsibilities - acceptable use
Use Pengon for what it’s for and you’ll never hit any of the limits below. The spirit: we’re a tiny team and our infrastructure budget is real. The rules are about keeping the service fast, the corpus clean, and the operator (us) out of regulatory trouble.
What you can’t do
Abuse the classifier:
- Scripting submissions to your own site to flood the classifier (load-testing, “poisoning” the training corpus, stress-testing for fun).
- Submitting content you don’t have permission to process - e.g. pasting another company’s contact-form submissions into a Pengon site you control just to see how they classify.
- Attempting to reverse-engineer the classifier, extract the fine-tuned adapter, or probe the prompt structure through adversarial submissions.
Use Pengon as a generic AI endpoint. Pengon’s classifier is sized and prompted for one task: deciding if a Squarespace contact-form submission is spam. Don’t pipe arbitrary text into the form endpoint to get cheap inference, build a downstream product on top of our endpoint, or otherwise treat Pengon as a general-purpose LLM.
Install on sites you don’t operate. Each Pengon account is for sites you legitimately own or manage on behalf of a client. Installing on a site without the operator’s permission violates this policy and likely Squarespace’s ToS too.
Run illegal or harmful operations. Don’t use Pengon in connection with sites that:
- Distribute child sexual abuse material, non-consensual intimate imagery, or incite real-world violence;
- Operate scams, phishing, or fraud against site visitors;
- Sell goods or services that are illegal in your jurisdiction (e.g. unregulated pharmaceuticals, sanctioned weapons, stolen credentials);
- Are designed to harvest contact information for unauthorised marketing or data resale.
Resell access. A Pengon account is for your sites, not for resale. Agencies wanting to offer Pengon to clients under their own brand: talk to us ([email protected]).
Try to break things on purpose. Probing for security vulnerabilities without coordinated disclosure (security research → email [email protected] first), denial-of-service attempts, circumventing rate limits or paywalls.
You also agree to
- Comply with applicable laws when using Pengon - including informing your visitors that contact-form submissions are processed by an AI classifier, if your jurisdiction requires it (some EU/UK contexts do).
- Keep your Pengon account credentials secure. We’re not responsible for unauthorised access caused by a leaked password on your end.
Consequences
Depending on severity, we may:
- Reach out. The default. Most issues are accidents (a test script left running, a misunderstanding of what the snippet does) and a single email resolves them.
- Throttle or pause. Temporary suspension of classification for the affected site while we sort it out.
- Terminate. For clear, intentional violations (CSAM, fraud operations, attempted resale of access), we terminate the account, delete associated data within 7 days, and report to authorities where legally required. Founding Member payments are non-refundable in termination-for-cause cases.
7. Refunds
The short version
- Subscriptions: you try before any charge. The 21-day free trial needs no payment method, so your first euro/dollar moves only after you choose to subscribe. Let the trial lapse and nothing is ever charged - protection just pauses.
- 14-day money-back guarantee on every plan. If you ask for a refund within 14 days of any first payment (a Founding Member payment, or the first charge of a monthly, annual, or agency plan), we refund it in full. No questions, no “please reconsider” emails.
- After 14 days: Founding Member payments are generally non-refundable; subscriptions can be cancelled at any time (stopping all future charges, with access through the period already paid), but the current period isn’t refunded pro-rata.
- If Pengon ever shuts down, Founding Members get a pro-rated refund based on time used vs. lifetime expected (see section 4); subscribers are simply never charged again.
The 14-day guarantee, in detail
You can request a full refund of any first payment - the $50 Founding Member payment, or the first $8.99 / $90 subscription charge after your trial - for any reason, or no reason, within 14 calendar days of being charged. This includes: the product isn’t what you expected; setup didn’t work on your Squarespace site; the spam-classification accuracy isn’t good enough for you; you changed your mind; any other reason.
For subscriptions this effectively means you get the 21-day no-card free trial and, once you subscribe, a 14-day guarantee on the first charge after it.
The 14-day window mirrors the EU consumer-rights cooling-off period and is offered to all customers regardless of where they live.
How to request a 14-day refund
Email [email protected] from the address you used to pay. Subject: “Refund request”. We’ll process the refund through Stripe within 3 business days; the money will arrive back on your card within 5–10 business days after that (Stripe’s timeline, not ours). We’ll also delete your Pengon account and quarantined submissions unless you explicitly ask us to keep them.
After the 14 days
After day 14, Founding Member payments are non-refundable except in the wind-down scenario in section 4. The thinking: $50 for lifetime access is already substantially below regular pricing, and we use that revenue to keep Pengon running.
Subscriptions aren’t locked in: cancel any time via Billing → Manage billing and no further charges happen. We don’t pro-rate the period you’re already in - you keep access until it ends. Renewal charges older than 14 days are non-refundable.
That said - if something goes seriously wrong (Pengon repeatedly mis-classifying real messages, sustained downtime, a billing issue) - email [email protected]. We deal with edge cases case-by-case. We’d rather have one well-handled refund than a customer who feels stuck.
Disputes & chargebacks
If something feels off, please email us before initiating a chargeback through your bank. Chargebacks cost us $15–$30 in non-refundable fees and result in your account being closed regardless of outcome. We genuinely don’t want that to happen - a 5-minute email almost always resolves things faster.
EU/UK consumer rights
EU and UK customers have additional statutory rights that Pengon’s refund policy doesn’t override. The 14-day cooling-off period above is your guaranteed minimum. By starting to use Pengon (connecting your Squarespace site and receiving the first classification), you’re explicitly consenting to the service beginning during the cooling-off period; you retain the right to a refund within 14 days but the service has been provided.
8. Privacy & data
How we handle your data is covered separately in our Privacy & Disclaimer. Short version: we store your submissions until you delete them, we don’t share data with third parties, and the anonymised training corpus is stripped of personally identifying information before storage.
Business customers processing personal data on behalf of others (e.g. agencies operating client sites) are covered by our pre-signed Data Processing Agreement under GDPR Art. 28 and the Swiss revFADP.
9. Intellectual property
Pengon - the name, brand, software, dashboard UI, classifier prompts, fine-tuned model adapters, and accumulated training corpus - remains the property of Quad Studio. You receive a personal, non-transferable, non-exclusive licence to use Pengon for the duration of your access.
Your submissions remain yours. We process them on your behalf and you can delete them at any time. The anonymised insights derived from the corpus (used to improve the classifier for everyone) are ours to use as described in the Privacy notice.
10. Limitation of liability
Pengon is a best-effort spam filter, not a guarantee. To the extent permitted by Swiss and applicable law, Quad Studio’s total liability arising from your use of Pengon is limited to the amount you paid us in the 12 months preceding the claim. For Founding Members, that’s the original $50.
We’re not liable for indirect damages - lost revenue from a missed real inquiry that Pengon wrongly classified as spam, for example. Always cross-check your spam folder periodically.
11. Termination
You can stop using Pengon at any time by deleting your account from the dashboard or emailing [email protected]. We will delete your submissions and revoke API access. If you’re within the 14-day window, you’ll receive a full refund.
We may suspend or terminate access if you violate these terms (abuse, payment fraud, illegal use). We’ll attempt to notify you and give a reasonable chance to remedy where possible.
12. Changes to these terms
We may update these terms over time. Material changes will be communicated by email to Founding Members at least 30 days before taking effect. The version date at the top of this page is the current effective date.
13. Governing law
These terms are governed by Swiss law. Any disputes will be resolved in the competent courts of Zürich, Switzerland, unless mandatory consumer-protection law gives you a different forum in your country of residence.
